TERMS OF SERVICE

GENERAL TERMS
★ You, the client, will be expected to read my TOS and by purchasing my service
★ By commissioning me, you agree that you have read and accepted all the terms listed here
★ I have the right to refuse or decline a commission for any reason
★ These terms may be changed/altered at any time so please be sure to read through them before contacting me.

REFERENCES & INFORMATION
★ Write in a clear and concise manner when filling out the commission form.
★ Please be as specific as possible when commissioning so your commission comes out the way you wanted!
★ Always provide visual references! Please provide all the necessary reference materials for your commission, I will NOT accept description only references!
★ Any references should be concise, up to date, and written in English

PAYMENT, FEES, & REFUNDS
★ All commissions will have an additional 7% sale tax fee!
★ Payment via PayPal Invoice, Ko-Fi, or VGen (USD Only!)
★ Only pay if I accept your commission request!
★ Payments are upfront and in full before the commission starts
★ I will NOT proceed with the commission if the payment isn’t given
★ Payments must be made within 48 hours, failure to pay will result in the cancellation of the commission
★ Additional accessories, specific backgrounds, and detailed characters have an additional cost.Refunds:★ If after the 6 months, I’ve yet to deliver the final artwork or discuss extra time to work on your commission, you may ask for a refund (in full or partially if the client requests it)
★ If I cancel a commission, any payment made will be refunded in full
★ Other than those few occasions, commissions are non-refundable after paymentPersonal Use:★ Personal use only UNLESS we discussed commercial usage.
★ Make sure you include credit! (i.e. credit to @outtasighttsh, the signature is intact, visible credit linking back to me, etc)
★ DO NOT try to commercially use the artwork that was made for personal use— especially if you use it for sale such as merchandise!Commercial Use and Merchandise Use:★ The client can always go back to the artist if the client decides they want to use the artwork commercially
★ Commercial prices are about 100% of the price
★ Merchandise Usage are about 300% of price
★ If you’re unsure if your commission request falls under personal or commercial use feel free to contact me!
★ Even in commercial usage, it is still required to give proper credit to the artist while using the artwork (i.e. credit to @outtasighttsh)

DEADLINES & DELIVERY
★ After accepting the request and payment is made, I will start the commission.
★ Will usually take me around 1 week to 6 months to complete the commission (depending on the commission and the queue)
★ You are always free to contact me to inquire about the progress of the commission.
★ If you have a specific deadline, you MUST let me know beforehand
★ A rush fee may be discussed depending on the delivery time that you requested (usually at least +25% of the commission)
★ Files delivery via email, discord, or VGen’s system.

REVISIONS
★ I will usually update the client during the sketching stage, where major and minor revisions/changes can be made with no limits
★ Please do give me on the sketch/WIP to ensure the result is how you envisioned it.
★ 3 minor changes are allowed before it will cost extra past the sketch stage ($1-$5)
★ Color changes/small corrections are okay at any stage, I won’t charge you for it
★ Do not ask for MAJOR revisions past the line art stage/things that already have been approved, unless I’ve made a mistake

COMMUNICATION
★ Communication will take place in email, dms, or Vgen’s messaging system, but if you have a preferred way of communicating/receiving updates, let me know
★ I will usually take 1-3 days to respond
★ Communication will take place with you throughout the entire process. I will ask for feedback at multiple stages
★ If there are any delays throughout this progress, I will let you know.Surprise Me/Skeb Commissions Specifics:★ There will be NO communication between me and you until the completion of the commission.
★ You can ask me for updates thoughNOTE: Remember that our communication is strictly professional

USE & INTELLECTUAL PROPERTY RIGHTS
★ I retain the rights to all illustrations/artworks
★ Provide all image credits to me
You may not claim my artwork as your own
★ I won’t post or use anything if you rather keep your commission piece private
★ In the case of an adoptable/custom, you retain the rights to the character design.
★ Tracing or editing the artwork with my knowledge is not allowedProhibited Actions★ The Client CANNOT use the artwork for AI generation and training, NFT, any blockchain/crypto, and any future/similar technology!
★ The Client CANNOT claim the artwork as their own
★ The Client CANNOT heavily edit over work or remove my watermark/signature
★ Any violators will be added to my blacklist!
